一(yi)(yi)、加(jia)班(ban)工(gong)(gong)(gong)資(zi)的計算(suan)(suan)基(ji)(ji)數(shu)(shu),可(ke)以(yi)按勞動合同當中(zhong)約定(ding)的基(ji)(ji)數(shu)(shu)為準(zhun),而不是(shi)一(yi)(yi)定(ding)要與(yu)員工(gong)(gong)(gong)實際(ji)全額工(gong)(gong)(gong)資(zi)進行核算(suan)(suan),但約定(ding)的這個基(ji)(ji)數(shu)(shu),不得低于(yu)當地月(yue)(yue)*工(gong)(gong)(gong)資(zi)標準(zhun)。比如小王每個月(yue)(yue)的實際(ji)工(gong)(gong)(gong)資(zi)是(shi)五千(qian),但勞動合同當中(zhong)注明了其加(jia)班(ban)工(gong)(gong)(gong)資(zi)的計算(suan)(suan)基(ji)(ji)數(shu)(shu)為二千(qian)五,且二千(qian)五已經高于(yu)了當地的月(yue)(yue)*工(gong)(gong)(gong)資(zi)標準(zhun),那么(me)在核算(suan)(suan)加(jia)班(ban)工(gong)(gong)(gong)資(zi)時,可(ke)以(yi)按照兩千(qian)五進行核算(suan)(suan)。

二、如果公司與員(yuan)工(gong)(gong)(gong),沒有在勞動(dong)合(he)同(tong)(tong)中明確約定(ding)加班工(gong)(gong)(gong)資的(de)(de)核算基數,但約定(ding)了(le)各類獎金、津貼、補貼等(deng)項目(mu)(mu),不屬于(yu)(yu)(yu)正常工(gong)(gong)(gong)作時間工(gong)(gong)(gong)資的(de)(de),則在計(ji)算加班工(gong)(gong)(gong)資時,核算基數為(wei)全額(e)工(gong)(gong)(gong)資減去以上(shang)這些項目(mu)(mu)之(zhi)后的(de)(de)余額(e)。如小(xiao)王每個月(yue)的(de)(de)實(shi)際(ji)工(gong)(gong)(gong)資是五(wu)千(qian),但其中有兩(liang)千(qian)元是獎金和津貼,那么他(ta)加班工(gong)(gong)(gong)資的(de)(de)核算基數就(jiu)是五(wu)千(qian)減去兩(liang)千(qian)等(deng)于(yu)(yu)(yu)三(san)千(qian)塊。但這樣計(ji)算的(de)(de)前(qian)提是雙方(fang)在勞動(dong)合(he)同(tong)(tong)當中注明了(le)獎金津貼這些項目(mu)(mu),不屬于(yu)(yu)(yu)正常工(gong)(gong)(gong)作時間的(de)(de)工(gong)(gong)(gong)資。

四、如果(guo)企業(ye)和員(yuan)工(gong)(gong)在(zai)勞(lao)動(dong)合(he)同(tong)中,明確約定了(le)員(yuan)工(gong)(gong)的月工(gong)(gong)資(zi)中已經包含了(le)加(jia)班工(gong)(gong)資(zi)的,一般視為(wei)有效。也就是(shi)只要(yao)企業(ye)在(zai)勞(lao)動(dong)合(he)同(tong)當中加(jia)入了(le)該員(yuan)工(gong)(gong)月工(gong)(gong)資(zi)中,已經包含了(le)加(jia)班費用這(zhe)句話,那么員(yuan)工(gong)(gong)主張加(jia)班工(gong)(gong)資(zi)就很難(nan)了(le),但如果(guo)當月加(jia)班總時(shi)長超過(guo)了(le)三十(shi)六(liu)個小(xiao)時(shi),還是(shi)可以另行主張加(jia)班工(gong)(gong)資(zi)的
