應屆(jie)生(sheng)的人生(sheng)第一(yi)份勞(lao)動合同,容易踩的 5 個坑如下(xia):

一、離職(zhi)不(bu)會有(you)違約金。不(bu)管(guan)是(shi)試用期還(huan)是(shi)轉正后,只要(yao)想離職(zhi),都(dou)可放心(xin)大(da)膽地提,即便合同(tong)上(shang)寫了相關條(tiao)款,也(ye)屬違法,不(bu)會生效(xiao)。

二(er)、證(zheng)件(jian)原(yuan)件(jian)一(yi)般只需復印件(jian)。原(yuan)件(jian)別隨便給出去(qu),以免被公(gong)司扣(kou)押。

三、空白合同(tong)不要簽。工作地點(dian)、崗位、薪(xin)資架構、試用(yong)期時(shi)長、試用(yong)期薪(xin)資等信息應在(zai)合同(tong)中有(you)完整(zheng)體現,確(que)認好后再簽,若合同(tong)空白,公司可隨意填(tian)寫,因(yin)已簽字就會生(sheng)效。

四、合同(tong)一(yi)式兩份(fen),自己(ji)那份(fen)要保管好:若有爭議,這是(shi)重要證據之(zhi)一(yi)。

五(wu)、關于試(shi)(shi)用(yong)(yong)期(qi)(qi)。試(shi)(shi)用(yong)(yong)期(qi)(qi)薪資(zi)可打折,但不(bu)(bu)能低于轉(zhuan)正后的(de)百分之八十(shi)。試(shi)(shi)用(yong)(yong)期(qi)(qi)時(shi)長(chang)有(you)規定(ding)(ding),勞動(dong)合(he)同期(qi)(qi)限(xian)在三(san)(san)個月(yue)以(yi)(yi)上(shang)不(bu)(bu)滿一(yi)年(nian)(nian)的(de),試(shi)(shi)用(yong)(yong)期(qi)(qi)不(bu)(bu)得(de)(de)超(chao)過(guo)一(yi)個月(yue);一(yi)年(nian)(nian)以(yi)(yi)上(shang)不(bu)(bu)滿三(san)(san)年(nian)(nian)的(de),試(shi)(shi)用(yong)(yong)期(qi)(qi)不(bu)(bu)得(de)(de)超(chao)過(guo)二個月(yue);三(san)(san)年(nian)(nian)以(yi)(yi)上(shang)固定(ding)(ding)期(qi)(qi)限(xian)和無固定(ding)(ding)期(qi)(qi)限(xian)的(de)勞動(dong)合(he)同,試(shi)(shi)用(yong)(yong)期(qi)(qi)不(bu)(bu)得(de)(de)超(chao)過(guo)六個月(yue)。

具(ju)體畢業(ye)生(sheng)簽訂勞(lao)動合同時需要(yao)注意以下方面:

一、必(bi)備(bei)條(tiao)款。根(gen)據《勞(lao)(lao)動(dong)合(he)同(tong)法》第十七條(tiao)規定(ding),勞(lao)(lao)動(dong)合(he)同(tong)應當具備(bei)用人(ren)單位(wei)的(de)名稱、住所和(he)法定(ding)代表人(ren)或者(zhe)主要(yao)負(fu)責(ze)人(ren);勞(lao)(lao)動(dong)者(zhe)的(de)姓(xing)名、住址和(he)居民身(shen)份證或者(zhe)其(qi)他(ta)有(you)效身(shen)份證件號(hao)碼;勞(lao)(lao)動(dong)合(he)同(tong)期(qi)限;工(gong)(gong)作(zuo)內容和(he)工(gong)(gong)作(zuo)地(di)點(dian);工(gong)(gong)作(zuo)時間(jian)和(he)休(xiu)息休(xiu)假;勞(lao)(lao)動(dong)報酬(chou);社會保險;勞(lao)(lao)動(dong)保護(hu)、勞(lao)(lao)動(dong)條(tiao)件和(he)職業危害防護(hu);法律、法規規定(ding)應當納入勞(lao)(lao)動(dong)合(he)同(tong)的(de)其(qi)他(ta)事(shi)項。除(chu)前款規定(ding)的(de)必(bi)備(bei)條(tiao)款外,用人(ren)單位(wei)與(yu)勞(lao)(lao)動(dong)者(zhe)可以約定(ding)試用期(qi)、培訓(xun)、保守(shou)秘密(mi)、補充保險和(he)福利待遇等其(qi)他(ta)事(shi)項。

二(er)、簽(qian)訂(ding)時(shi)間(jian)。建立(li)(li)勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi),應(ying)當訂(ding)立(li)(li)書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)動合(he)(he)同(tong)(tong)(tong),已建立(li)(li)勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi),未(wei)同(tong)(tong)(tong)時(shi)訂(ding)立(li)(li)書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)動合(he)(he)同(tong)(tong)(tong)的(de),應(ying)當自(zi)用(yong)工(gong)之日起(qi)一(yi)個(ge)月內訂(ding)立(li)(li)書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)動合(he)(he)同(tong)(tong)(tong),用(yong)人單位與(yu)勞(lao)(lao)(lao)(lao)動者(zhe)在用(yong)工(gong)前訂(ding)立(li)(li)勞(lao)(lao)(lao)(lao)動合(he)(he)同(tong)(tong)(tong)的(de),勞(lao)(lao)(lao)(lao)動關(guan)(guan)系(xi)自(zi)用(yong)工(gong)之日起(qi)建立(li)(li)。用(yong)人單位自(zi)用(yong)工(gong)之日起(qi)超過 1 個(ge)月不(bu)滿 1 年未(wei)與(yu)勞(lao)(lao)(lao)(lao)動者(zhe)訂(ding)立(li)(li)書(shu)(shu)面(mian)勞(lao)(lao)(lao)(lao)動合(he)(he)同(tong)(tong)(tong)的(de),應(ying)當向勞(lao)(lao)(lao)(lao)動者(zhe)每月支(zhi)付(fu)二(er)倍的(de)工(gong)資。

三(san)、合(he)同類型。勞動合(he)同分為固定期限、無固定期限和以(yi)完成(cheng)一定工(gong)作任務為期限三(san)類。

四、試(shi)用(yong)期(qi)(qi)(qi)規(gui)定(ding)(ding)。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)三個月以上(shang)(shang)不滿(man)一年的(de),試(shi)用(yong)期(qi)(qi)(qi)不得(de)(de)超過(guo) 1 個月;勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)一年以上(shang)(shang)不滿(man)三年的(de),試(shi)用(yong)期(qi)(qi)(qi)不得(de)(de)超過(guo) 2 個月;三年以上(shang)(shang)固(gu)定(ding)(ding)期(qi)(qi)(qi)限(xian)和無固(gu)定(ding)(ding)期(qi)(qi)(qi)限(xian)的(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong),試(shi)用(yong)期(qi)(qi)(qi)不得(de)(de)超過(guo) 6 個月。同(tong)一用(yong)人單(dan)位(wei)與同(tong)一勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)只能約定(ding)(ding)一次試(shi)用(yong)期(qi)(qi)(qi)。試(shi)用(yong)期(qi)(qi)(qi)的(de)工(gong)資不得(de)(de)低(di)于本單(dan)位(wei)相同(tong)崗位(wei)*檔工(gong)資或(huo)者(zhe)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)約定(ding)(ding)工(gong)資的(de) 80%,并不得(de)(de)低(di)于用(yong)人單(dan)位(wei)所在(zai)地(di)的(de)*工(gong)資標準。試(shi)用(yong)期(qi)(qi)(qi)包含在(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)內,用(yong)人單(dan)位(wei)應當自用(yong)工(gong)之日起(qi) 30 日內為職工(gong)向(xiang)社(she)會(hui)保險經辦(ban)機構申請(qing)辦(ban)理社(she)會(hui)保險登記(ji)。用(yong)人單(dan)位(wei)不得(de)(de)無理由隨(sui)意解(jie)(jie)除與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)在(zai)試(shi)用(yong)期(qi)(qi)(qi)內的(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)在(zai)試(shi)用(yong)期(qi)(qi)(qi)間(jian)被證明(ming)不符合(he)(he)(he)錄用(yong)條件的(de),用(yong)人單(dan)位(wei)可以解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)。

五、其他注(zhu)意(yi)(yi)(yi)(yi)事項。避(bi)免簽(qian)訂 “自愿放棄(qi)繳(jiao)納(na)社會(hui)(hui)保險(xian)費(fei)” 的(de)(de)(de)協議,社會(hui)(hui)保險(xian)屬(shu)于(yu)(yu)國家強制(zhi)性保險(xian),用(yong)(yong)人單(dan)(dan)(dan)(dan)位(wei)和勞(lao)動(dong)(dong)者(zhe)(zhe)必(bi)須(xu)依(yi)法參加社會(hui)(hui)保險(xian),繳(jiao)納(na)社會(hui)(hui)保險(xian)費(fei);注(zhu)意(yi)(yi)(yi)(yi)勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)是(shi)否具備《勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)法》規(gui)定(ding)(ding)的(de)(de)(de)必(bi)備條(tiao)款(kuan),以及(ji)有關用(yong)(yong)人單(dan)(dan)(dan)(dan)位(wei)義務和勞(lao)動(dong)(dong)者(zhe)(zhe)權利的(de)(de)(de)條(tiao)款(kuan)是(shi)否缺失(shi);意(yi)(yi)(yi)(yi)向書(shu)不(bu)(bu)能代替勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong),勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)一(yi)般產生(sheng)于(yu)(yu)意(yi)(yi)(yi)(yi)向書(shu)之后(hou),如(ru)果(guo)勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)約(yue)(yue)定(ding)(ding)的(de)(de)(de)內容與意(yi)(yi)(yi)(yi)向書(shu)不(bu)(bu)一(yi)致,那么視為(wei)用(yong)(yong)人單(dan)(dan)(dan)(dan)位(wei)與勞(lao)動(dong)(dong)者(zhe)(zhe)就同(tong)(tong)(tong)(tong)(tong)一(yi)問(wen)題作了(le)新的(de)(de)(de)約(yue)(yue)定(ding)(ding),應(ying)(ying)以勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)為(wei)準;對(dui)于(yu)(yu)一(yi)些單(dan)(dan)(dan)(dan)位(wei)為(wei)員工(gong)提供的(de)(de)(de)如(ru)出國進修(xiu)等(deng)(deng)(deng)特殊(shu)培(pei)訓,需注(zhu)意(yi)(yi)(yi)(yi)服(fu)務期限的(de)(de)(de)約(yue)(yue)定(ding)(ding);用(yong)(yong)人單(dan)(dan)(dan)(dan)位(wei)通(tong)常會(hui)(hui)將《員工(gong)手冊》、相關規(gui)章制(zhi)度等(deng)(deng)(deng)附在(zai)(zai)勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)后(hou)面,或(huo)在(zai)(zai)勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)中(zhong)約(yue)(yue)定(ding)(ding)上述文(wen)件(jian)為(wei)附件(jian),經過確認告知的(de)(de)(de)附件(jian)對(dui)雙(shuang)方均(jun)有效,雙(shuang)方均(jun)應(ying)(ying)遵守;勞(lao)動(dong)(dong)者(zhe)(zhe)應(ying)(ying)要求與用(yong)(yong)人單(dan)(dan)(dan)(dan)位(wei)訂立書(shu)面合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong),并保留一(yi)份合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong),合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)文(wen)本(ben)應(ying)(ying)由(you)用(yong)(yong)人單(dan)(dan)(dan)(dan)位(wei)和勞(lao)動(dong)(dong)者(zhe)(zhe)各(ge)執一(yi)份;如(ru)果(guo)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)上的(de)(de)(de)單(dan)(dan)(dan)(dan)位(wei)與入職企業不(bu)(bu)一(yi)致,需特別注(zhu)意(yi)(yi)(yi)(yi)審查中(zhong)間是(shi)否存(cun)在(zai)(zai)第(di)三(san)方單(dan)(dan)(dan)(dan)位(wei),以及(ji)承包(bao)方有無履行(xing)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)的(de)(de)(de)資質和能力等(deng)(deng)(deng);仔細閱讀(du)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)約(yue)(yue)定(ding)(ding),拒(ju)絕簽(qian)訂女職工(gong)不(bu)(bu)得結婚生(sheng)育、因工(gong)負傷(shang)(shang)的(de)(de)(de) “工(gong)傷(shang)(shang)自理”、要求勞(lao)動(dong)(dong)者(zhe)(zhe)簽(qian)訂生(sheng)死契(qi)約(yue)(yue)等(deng)(deng)(deng)不(bu)(bu)合(he)(he)(he)(he)(he)(he)法的(de)(de)(de)內容;注(zhu)意(yi)(yi)(yi)(yi)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)中(zhong)關于(yu)(yu)勞(lao)動(dong)(dong)報酬(chou)的(de)(de)(de)構(gou)成、工(gong)作崗位(wei)、工(gong)作地(di)點、支(zhi)付(fu)方式與支(zhi)付(fu)時(shi)間等(deng)(deng)(deng)信(xin)息(xi)(xi)是(shi)否明確具體;在(zai)(zai)簽(qian)訂勞(lao)動(dong)(dong)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)時(shi),要了(le)解清楚單(dan)(dan)(dan)(dan)位(wei)的(de)(de)(de)基本(ben)情況,判斷其是(shi)否為(wei)合(he)(he)(he)(he)(he)(he)法企業,并將相關信(xin)息(xi)(xi)明確寫(xie)在(zai)(zai)合(he)(he)(he)(he)(he)(he)同(tong)(tong)(tong)(tong)(tong)中(zhong)。
