但是(shi)用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)基于勞(lao)(lao)(lao)動合(he)(he)同法(fa)的(de)規(gui)定(ding)(ding)(ding)在(zai)勞(lao)(lao)(lao)動合(he)(he)同中(zhong)對法(fa)定(ding)(ding)(ding)解(jie)除(chu)(chu)條件可以進行(xing)具體(ti)的(de)量化(hua),這是(shi)可以的(de)。比如(ru)說在(zai)勞(lao)(lao)(lao)動合(he)(he)同中(zhong)明確約定(ding)(ding)(ding)勞(lao)(lao)(lao)動者(zhe)嚴重(zhong)違反用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)規(gui)章制(zhi)度(du)的(de)具體(ti)的(de)情形(xing)是(shi)哪些(xie),并據此解(jie)除(chu)(chu)勞(lao)(lao)(lao)動合(he)(he)同是(shi)可以的(de)。用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)還可以制(zhi)定(ding)(ding)(ding)管(guan)理制(zhi)度(du)、考(kao)核(he)制(zhi)度(du)對員(yuan)工(gong)的(de)工(gong)作(zuo)進行(xing)考(kao)核(he)管(guan)理,比如(ru)對銷售(shou)人(ren)(ren)員(yuan)設定(ding)(ding)(ding)符合(he)(he)實(shi)際的(de)銷售(shou)指標,如(ru)果銷售(shou)人(ren)(ren)員(yuan)業績(ji)不達標是(shi)員(yuan)工(gong)的(de)工(gong)作(zuo)能力達不到崗位(wei)(wei)需(xu)求(qiu)的(de)表(biao)現,也是(shi)不勝(sheng)(sheng)任工(gong)作(zuo)的(de)表(biao)現。根據勞(lao)(lao)(lao)動合(he)(he)同法(fa)第四(si)十條的(de)規(gui)定(ding)(ding)(ding),勞(lao)(lao)(lao)動者(zhe)不勝(sheng)(sheng)任工(gong)作(zuo)的(de),用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)應先進行(xing)培(pei)訓或(huo)調崗處理,如(ru)果培(pei)訓或(huo)調崗處理后仍不能勝(sheng)(sheng)任的(de),用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)才(cai)有權解(jie)除(chu)(chu)勞(lao)(lao)(lao)動合(he)(he)同,而且(qie)此種情況下用(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)解(jie)除(chu)(chu)勞(lao)(lao)(lao)動合(he)(he)同仍是(shi)需(xu)要支付勞(lao)(lao)(lao)動者(zhe)經濟(ji)補償的(de)。因(yin)此銷售(shou)員(yuan)業績(ji)不達標并不能直接(jie)解(jie)除(chu)(chu)他的(de)勞(lao)(lao)(lao)動合(he)(he)同。
