我們身邊有(you)很多人(ren)(ren)喜歡共享用(yong)(yong)工(gong)(gong)(gong)(gong)的(de)(de)(de)(de)(de)(de)(de)模式,但是(shi)(shi)如(ru)果員(yuan)(yuan)工(gong)(gong)(gong)(gong)和(he)(he)一(yi)個(ge)企業沒(mei)有(you)長(chang)期穩定(ding)(ding)和(he)(he)固定(ding)(ding)的(de)(de)(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi)的(de)(de)(de)(de)(de)(de)(de)話(hua),就(jiu)會(hui)產(chan)生(sheng)另外一(yi)個(ge)問題,就(jiu)是(shi)(shi)員(yuan)(yuan)工(gong)(gong)(gong)(gong)穩定(ding)(ding)性就(jiu)沒(mei)有(you)那么好。那么共享用(yong)(yong)工(gong)(gong)(gong)(gong)、兼職用(yong)(yong)工(gong)(gong)(gong)(gong)、靈(ling)活用(yong)(yong)工(gong)(gong)(gong)(gong)的(de)(de)(de)(de)(de)(de)(de)方式,企業擔(dan)心的(de)(de)(de)(de)(de)(de)(de)部分也就(jiu)是(shi)(shi)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在(zai)待崗(gang)期間會(hui)去尋求(qiu)其(qi)他(ta)的(de)(de)(de)(de)(de)(de)(de)工(gong)(gong)(gong)(gong)作(zuo)機會(hui),這樣的(de)(de)(de)(de)(de)(de)(de)話(hua)一(yi)個(ge)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在(zai)同(tong)(tong)一(yi)時(shi)期內就(jiu)會(hui)和(he)(he)兩(liang)個(ge)或兩(liang)個(ge)以上(shang)的(de)(de)(de)(de)(de)(de)(de)用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)存在(zai)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi)。而勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)法規定(ding)(ding)說(shuo)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者一(yi)般只能和(he)(he)一(yi)個(ge)用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)建立(li)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi),隸屬(shu)存在(zai)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi)的(de)(de)(de)(de)(de)(de)(de)這個(ge)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)為(wei)他(ta)繳(jiao)納(na)社(she)會(hui)保險,建立(li)人(ren)(ren)事檔案。那么其(qi)他(ta)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)不可(ke)能重復(fu)地(di)為(wei)他(ta)建立(li)人(ren)(ren)事檔案繳(jiao)納(na)社(she)保,那么勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)法一(yi)直是(shi)(shi)沿(yan)用(yong)(yong)這個(ge)法條和(he)(he)規則的(de)(de)(de)(de)(de)(de)(de)。勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)法第(di)三十八條第(di)四款有(you)這樣的(de)(de)(de)(de)(de)(de)(de)規定(ding)(ding),說(shuo)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者同(tong)(tong)時(shi)和(he)(he)其(qi)他(ta)用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)建立(li)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi),對(dui)完成本單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)(de)(de)(de)(de)工(gong)(gong)(gong)(gong)作(zuo)任務(wu)造成嚴重影(ying)響(xiang)或者經(jing)用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)提出拒不改正的(de)(de)(de)(de)(de)(de)(de),用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)可(ke)單(dan)(dan)(dan)方解除(chu)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)。那么第(di)九(jiu)十一(yi)條規定(ding)(ding)說(shuo)用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)招(zhao)用(yong)(yong)和(he)(he)其(qi)他(ta)用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)尚未(wei)解除(chu)或者終止勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)的(de)(de)(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者,給其(qi)他(ta)用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)造成損(sun)失(shi)的(de)(de)(de)(de)(de)(de)(de)應當承擔(dan)連帶(dai)的(de)(de)(de)(de)(de)(de)(de)賠(pei)償責任。根據上(shang)述的(de)(de)(de)(de)(de)(de)(de)規定(ding)(ding),在(zai)雙重或者多重勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi)中,只要勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者沒(mei)有(you)給原單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)造成損(sun)失(shi),那和(he)(he)其(qi)他(ta)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)建立(li)勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi)的(de)(de)(de)(de)(de)(de)(de)行為(wei)并不違法。而在(zai)現實(shi)的(de)(de)(de)(de)(de)(de)(de)用(yong)(yong)工(gong)(gong)(gong)(gong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi)中,一(yi)般雙重勞(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)(guan)(guan)(guan)系(xi)(xi)(xi)(xi)的(de)(de)(de)(de)(de)(de)(de)情況主(zhu)要包(bao)括(kuo)。
一、就是(shi)勞動者在一個企業(ye)內(nei)部(bu)停(ting)薪留職、未達(da)到法(fa)定(ding)退(tui)休年齡(ling)內(nei)退(tui)了(le)或者是(shi)下(xia)崗待(dai)崗人(ren)員(yuan)以及企業(ye)經營(ying)性停(ting)產放(fang)長假的(de)(de)人(ren)員(yuan)。那么最高(gao)人(ren)民法(fa)院(yuan)關(guan)于審(shen)理(li)勞動爭(zheng)議(yi)案件(jian)適用法(fa)律若干(gan)規定(ding)的(de)(de)解釋三也有規定(ding)說,且停(ting)薪留職、未達(da)到法(fa)定(ding)退(tui)休年齡(ling)的(de)(de)內(nei)退(tui)人(ren)員(yuan)、下(xia)崗待(dai)崗人(ren)員(yuan)以及企業(ye)經營(ying)性停(ting)產放(fang)長假人(ren)員(yuan)因與新的(de)(de)用人(ren)單位發生爭(zheng)議(yi),提起訴(su)訟的(de)(de),那么法(fa)院(yuan)應當按照勞動關(guan)系來處理(li)。
二、就是(shi)非全(quan)日制(zhi)用工(gong)。包括每天工(gong)作(zuo)不(bu)超過四個(ge)小時或者(zhe)是(shi)小時工(gong)這種用工(gong)形式(shi)。從事非全(quan)日制(zhi)用工(gong)的勞動(dong)者(zhe)可以與一個(ge)或一個(ge)以上用工(gong)單(dan)位訂立勞動(dong)合(he)同,但是(shi)后訂立的勞動(dong)合(he)同不(bu)得影響先訂立的勞動(dong)合(he)同的履(lv)行。
三、就是(shi)兼職(zhi)。那么兼職(zhi)有(you)三種情形,一類是(shi)勞(lao)(lao)動(dong)者向(xiang)用(yong)人(ren)單(dan)位提(ti)供不定時的(de)技術或者信(xin)息咨詢服務(wu),我(wo)們(men)一般叫他為顧(gu)問式服務(wu)。第(di)二類呢(ni)就是(shi)勞(lao)(lao)動(dong)者提(ti)供勞(lao)(lao)務(wu)服務(wu)的(de)臨時性(xing)用(yong)工(gong)比較多。第(di)三類呢(ni)就是(shi)勞(lao)(lao)動(dong)者定時向(xiang)用(yong)人(ren)單(dan)位提(ti)供非全(quan)日制勞(lao)(lao)動(dong),兼職(zhi)服務(wu)以一家(jia)以上的(de)企業也很正(zheng)常,一般不會產生爭議。
四、就是共(gong)(gong)享用工(gong)。一般像(xiang)勞(lao)務派(pai)(pai)遣公(gong)司、缺(que)工(gong)企業(ye)和勞(lao)動(dong)(dong)(dong)力營與企業(ye)之間(jian)實行(xing)的(de)這(zhe)種(zhong)共(gong)(gong)享用工(gong)進行(xing)用工(gong)逾缺(que)的(de)司發調劑,屬(shu)于勞(lao)動(dong)(dong)(dong)力戒(jie)掉行(xing)為。在一定程度(du)上提高(gao)了人力資源(yuan)的(de)配置(zhi)效率(lv),但共(gong)(gong)享員(yuan)工(gong)并未(wei)改(gai)變原(yuan)用人單位(wei)和勞(lao)動(dong)(dong)(dong)者之間(jian)的(de)勞(lao)動(dong)(dong)(dong)關系。可以(yi)安排(pai)被戒(jie)掉員(yuan)工(gong)和原(yuan)用人單位(wei)簽訂書面的(de)變更勞(lao)動(dong)(dong)(dong)合同協(xie)議,只要不做違法(fa)派(pai)(pai)遣,那(nei)么(me)做好員(yuan)工(gong)的(de)勞(lao)動(dong)(dong)(dong)保護權益的(de)保護,基本(ben)也不會有爭議和問(wen)題出現。
