用人單位用工自主權的三種情況

一、調(diao)整(zheng)勞(lao)動者工(gong)作(zuo)崗(gang)位是用人單位生產(chan)經營的需(xu)要。

二、調整工(gong)作(zuo)崗(gang)位后,勞動者的工(gong)資水平和原崗(gang)位基本相當(dang)。不能把別人的工(gong)資直接從八千降(jiang)到三千,這就(jiu)不合理。

三、不具有(you)侮(wu)辱性(xing)和懲罰性(xing)。把一個銷售總監直接調整(zheng)為(wei)庫管,那就(jiu)是具有(you)侮(wu)辱性(xing)。

一(yi)旦企業(ye)能夠(gou)證(zheng)明自己是(shi)(shi)在行使(shi)用工(gong)(gong)自主權(quan),就可以(yi)調整(zheng)員工(gong)(gong)的(de)工(gong)(gong)作崗(gang)位(wei)(wei),那勞(lao)動(dong)(dong)者以(yi)用人單位(wei)(wei)擅自調整(zheng)其工(gong)(gong)作崗(gang)位(wei)(wei)為(wei)(wei)由,要求解除勞(lao)動(dong)(dong)合(he)同(tong),并請求用人單位(wei)(wei)支(zhi)付經濟補(bu)償(chang)(chang)的(de),將不(bu)會得到支(zhi)持。所(suo)以(yi)對于調崗(gang)是(shi)(shi)否一(yi)定(ding)需(xu)要協商一(yi)致的(de)判定(ding),千萬不(bu)能一(yi)刀切,勞(lao)動(dong)(dong)者切勿認為(wei)(wei)自己一(yi)定(ding)占理,盲目的(de)以(yi)曠(kuang)工(gong)(gong)等過激手段(duan)進(jin)行應對,否則用人單位(wei)(wei)可以(yi)直接以(yi)勞(lao)動(dong)(dong)者嚴(yan)重違反企業(ye)規章制度為(wei)(wei)由將其辭(ci)退,且(qie)不(bu)支(zhi)付任何的(de)補(bu)償(chang)(chang)。當然,企業(ye)也不(bu)能因為(wei)(wei)有(you)這個(ge)權(quan)利,就隨意(yi)亂(luan)來,實踐(jian)中要證(zheng)明,自己在合(he)法(fa)使(shi)用用工(gong)(gong)自主權(quan),也是(shi)(shi)不(bu)容易(yi)的(de),和諧(xie)勞(lao)動(dong)(dong)關(guan)系,需(xu)要大家共同(tong)努力。
