第(di)一種情(qing)況,就(jiu)是(shi)如(ru)果(guo)年(nian)(nian)(nian)終(zhong)獎(jiang)是(shi)固定(ding)(ding)(ding)的(de)或者(zhe)有具體的(de)計算標(biao)準。比如(ru)勞動合同約定(ding)(ding)(ding)了年(nian)(nian)(nian)薪(xin)是(shi)20萬,平均(jun)每個月先發1萬,到年(nian)(nian)(nian)底的(de)時(shi)候,再(zai)補8萬,這個年(nian)(nian)(nian)終(zhong)獎(jiang)必(bi)須(xu)要發。比如(ru)如(ru)果(guo)是(shi)十(shi)(shi)三薪(xin)或者(zhe)十(shi)(shi)四薪(xin)的(de)也是(shi)如(ru)此,年(nian)(nian)(nian)終(zhong)的(de)時(shi)候一定(ding)(ding)(ding)要拿到第(di)13或者(zhe)第(di)14薪(xin)的(de)薪(xin)水(shui)。
第二種情況,如果公(gong)司(si)關于年終(zhong)獎沒有(you)過任(ren)何(he)提前的約(yue)定(ding),這(zhe)也是(shi)比(bi)較(jiao)常見的情況。公(gong)司(si)就有(you)權單方決定(ding)根據經營的狀況,決定(ding)是(shi)否給大家發(fa)年終(zhong)獎,發(fa)多發(fa)少或者不(bu)發(fa),都只能服從(cong),不(bu)能強制要(yao)求。
